Terms of Use
Last updated: September 28, 2026
These Terms of Use (“Terms”) govern your access to and use of fundcube.io and the related services provided by World Power Enterprises LLC, doing business as FundCube (“FundCube,” “we,” “us,” or “our”). By accessing the Website or submitting an inquiry or application, you agree to these Terms. If you do not agree, do not use the Website or Services.
1. Eligibility and Business Purpose
You must be at least 18 years old and legally capable of entering into a binding agreement. You may submit a funding request only on behalf of a legitimate business and only if you are authorized to act for that business. The Services are intended for commercial and business purposes, not personal, family, or household borrowing.
2. FundCube’s Role
FundCube is a marketing, referral, and business-financing introduction service. FundCube is not a lender and does not directly provide loans or other financing. We do not make credit decisions, approve applications, determine final eligibility, establish pricing or terms, or guarantee that any provider will make an offer.
We may introduce an applicant to one or more independent lenders, funders, brokers, marketplaces, or other financing providers (“Funding Providers”). Each Funding Provider independently determines its products, underwriting standards, approval decisions, amounts, costs, fees, repayment or remittance terms, collateral or guarantee requirements, and funding timing.
FundCube may receive compensation from a Funding Provider or other partner in connection with an introduction, completed transaction, or related service. You may ask us or the applicable provider for information about compensation relevant to a proposed transaction.
3. No Guarantee or Obligation
Submitting an inquiry or application:
- Does not guarantee approval, an offer, a particular amount, pricing, or funding date.
- Does not obligate you to accept an offer.
- Does not create a lender-borrower, fiduciary, advisory, or agency relationship between you and FundCube.
- Does not mean every potentially available product or provider has been considered.
Any offer is subject to the Funding Provider’s verification, underwriting, documentation, and agreement requirements. Review all final documents carefully before accepting. You should consider obtaining independent legal, tax, accounting, or financial advice where appropriate.
4. Application Information and Authorization
You agree to provide complete, current, and accurate information and authentic, unaltered documents. You must promptly correct information that becomes inaccurate before a transaction is completed.
When you submit a business-funding application and select the applicable authorization, you authorize FundCube to:
- Receive and review the information and documents you provide.
- Contact you concerning your request.
- Disclose relevant information and documents to prospective Funding Providers and operational service providers for evaluation, verification, fraud prevention, and processing.
- Receive information from Funding Providers regarding the status and outcome of your request.
Any consumer credit inquiry or other authorization requiring separate consent will be requested separately where required. Do not submit online-banking passwords, login credentials, or information the form does not expressly request.
5. Uploaded Documents and Email Delivery
You may be asked to upload complete business bank statements or other business records. You represent that you are authorized to provide those documents and that doing so does not violate any agreement, duty, or law.
Our current application workflow may transmit uploaded documents to a designated FundCube business email account as attachments. Email services may retain copies and are not an end-to-end encrypted document vault. By choosing to submit through this workflow, you acknowledge this method of transmission. Do not submit Social Security numbers, personal dates of birth, banking passwords, or other information the application does not expressly request.
We may reject files that exceed stated limits, are incomplete, contain malware, use unsupported formats, or appear altered or fraudulent.
6. Communications and Marketing Consent
You authorize us to use the contact information you provide to respond to and service your request. Application-related communications may include telephone calls, emails, or text messages where permitted by law.
Marketing consent is separate and is not a condition of receiving the Services. If you expressly consent to marketing text messages, message frequency may vary, message and data rates may apply, and you may reply STOP to opt out or HELP for assistance. You may unsubscribe from marketing emails using the link provided in the message.
Your telecommunications carrier is not responsible for delayed or undelivered messages. You represent that you are the subscriber or customary user of any telephone number you provide and agree to notify us if that number changes.
7. Acceptable Use
You may not:
- Use the Website or Services for an unlawful, deceptive, fraudulent, or abusive purpose.
- Impersonate another person or business or submit information without authority.
- Upload false, manipulated, malicious, infringing, or unlawfully obtained content.
- Attempt to gain unauthorized access to systems, accounts, or data.
- Interfere with the Website’s availability, security, or operation.
- Introduce malware, scrape the Website at unreasonable volume, or circumvent technical controls.
- Use Website content or data to build a competing database or service without written permission.
We may suspend or block access, reject a submission, preserve evidence, or report suspected misconduct when reasonably necessary.
8. Funding Providers and Third-Party Services
Funding Providers and other third parties are independent from FundCube. Their websites, communications, products, contracts, privacy practices, and conduct are governed by their own terms and policies. FundCube is not responsible for a third party’s acts, omissions, underwriting decision, agreement, servicing, collection activity, security, or compliance.
Before accepting any offer, review the provider’s identity and written agreement, including the amount delivered, total repayment or purchased amount, fees, payment frequency, estimated term, reconciliation rights where applicable, security interests, guarantees, default provisions, and other material terms.
9. Intellectual Property
The Website and its content, design, text, graphics, logos, software, and other materials are owned by or licensed to FundCube and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Website for its intended purpose.
You retain ownership of materials you submit. You grant FundCube a limited license to host, copy, process, transmit, and disclose those materials as reasonably necessary to provide the Services, comply with law, and exercise the authorizations you give us.
10. Website Availability and Disclaimer of Warranties
We may change, suspend, or discontinue any portion of the Website or Services. We do not promise uninterrupted, timely, error-free, or completely secure operation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FUNDCUBE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RESULTS. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDCUBE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES; OR DAMAGES ARISING FROM A FUNDING PROVIDER’S DECISION, OFFER, AGREEMENT, CONDUCT, OR FAILURE TO FUND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDCUBE’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE OR SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO FUNDCUBE FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless FundCube and its members, officers, employees, contractors, and agents from claims, damages, losses, liabilities, and reasonable costs arising from your material breach of these Terms, unlawful use of the Services, lack of authority to submit information or documents, or infringement of another party’s rights.
13. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information and is incorporated into these Terms by reference.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Unless applicable law requires otherwise, any legal action arising from these Terms or the Services must be brought in a state or federal court located in Broward County, Florida, and each party consents to those courts’ jurisdiction and venue.
This section does not prevent either party from seeking appropriate relief in small-claims court or requesting temporary or emergency injunctive relief where legally available.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised “Last updated” date. Changes apply prospectively when posted unless a later effective date is stated. If required by law, we will provide additional notice. Your continued use after the effective date constitutes acceptance of the revised Terms.
16. General Provisions
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a corporate transaction or transfer of the Services. These Terms, together with incorporated policies and any application-specific authorization, constitute the entire agreement concerning your use of the Website and Services.
